Terms of Service

1. Acceptance

By creating an account or using Wayqast, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Description of service

Wayqast is an SMS broadcast platform that lets you send group SMS messages from a web dashboard using an Android phone you own as an SMS gateway. The service is provided on a subscription basis.

3. Eligibility

You must be at least 18 years old and legally able to enter into contracts in your jurisdiction to use Wayqast.

4. Acceptable use

You agree to use Wayqast only for lawful purposes and in compliance with all applicable laws, including anti-spam regulations (RGPD, CAN-SPAM, CASL, or equivalent). In particular you must not:

  • Send unsolicited commercial messages (spam) to contacts who have not opted in.
  • Send harassing, threatening, or abusive messages.
  • Impersonate another person or organisation.
  • Use the service to transmit illegal content.
  • Attempt to interfere with or disrupt the service.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

5. Your responsibilities

  • You are responsible for obtaining the necessary consent from every phone number you add to your contact groups before sending them SMS messages.
  • You are responsible for ensuring your use of the service complies with your local telecommunications and data protection laws.
  • You are responsible for the security of your account credentials.
  • Your gateway phone and its SIM card remain under your responsibility. SMS messages are sent using your own phone plan — any costs incurred with your mobile operator are your own.

6. Subscription and payment

Wayqast is billed at €10 per month. Payment details are managed through our payment processor. Subscriptions renew automatically until cancelled. You may cancel at any time from your dashboard settings.

7. Intellectual property

Wayqast and its original content, features, and functionality are owned by us and protected by applicable intellectual property laws. You retain all rights to the content (messages, contact data) you input into the service.

8. Limitation of liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to undelivered SMS messages, service interruptions, or loss of data.

9. Termination

You may delete your account at any time by contacting us at [email protected]. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

10. Changes to these terms

We may modify these Terms from time to time. The date at the top of this page reflects the latest revision. Continued use of the service after changes constitutes your acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of France. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of France.
